Your VA Benefits Are Fully Protected in Bankruptcy

Good news: Filing bankruptcy does NOT stop, reduce, or take away your VA disability payments, pension, or other VA benefits. Since 2019, federal law treats VA benefits exactly like Social Security—100% safe from creditors and the bankruptcy trustee.

1. The HAVEN Act (2019) – Your Shield

  • Excludes all VA and DoD disability payments from the “means test” (the income math that decides Chapter 7 vs. Chapter 13).
  • Result: More veterans qualify for Chapter 7 (total wipe-out of credit cards, medical bills, etc.) instead of being forced into a 3–5 year Chapter 13 payment plan.
